The Client: The company or individual requesting the services of JP Web Creations.
JP Web Creations: Primary designer/site owner & employees or affiliates.
JP Web Creations will carry out work where an agreement is provided by either email, telephone or in-person. An ‘order’ is deemed to be a written or verbal contract between JP Web Creations and the client, this includes telephone and email agreements.
Charges for services to be provided by JP Web Creations are defined in the project quotation or invoice that the Client receives via e-mail. Quotations are valid for a period of 30 days. Invoices are due for payment immediately unless stated otherwise, according to the payment terms outlined below. JP Web Creations reserves the right to alter or decline to provide a quotation after the expiry of the 30 days.
Unless agreed otherwise with the Client, all website design services require an advance payment of a minimum of 50 per cent of the project quotation total before the work is supplied to the Client for review. A second charge of 50 per cent is required upon completion of the work, prior to upload to the server or release of materials.
Payment for services is due by bank transfer. Bank details will be made available on invoices.
After a deposit payment is received, JP Web Creations will complete a draft design for review by the client. If the client is happy we will continue to complete a full design. If the client changes their mind about the design after the point of accepting the draft. JP Web Creations reserves the right to charge additional design costs, proportionate to the overall cost of the website agreement.
JP Web Creations will confirm to the client the anticipated start and finish date for their order. This date is subject to change depending on factors such as the client delivering the required content in a timely manner. JP Web Creations will keep the client informed at all times if there is going to be a delay. JP Web Creations cannot be held accountable for delays which would fall under the ‘force Majeure’ bracket.
JP Web Creations is a small business and to remain efficient we request that all clients produce and provide us with the relevant content in a timely manner. If the client is slow to provide this information, we will request that the final payment is made. Prior to completing the project.
A delay in providing JP Web Creations with the relevant content will have a knock-on effect and as such, will most likely delay the production of the client’s website.
NOTE: All website content unless otherwise agreed should be delivered in ‘Microsoft Word’ format, with each page clearly labelled. Large images should be sent via WeTransfer.
Whilst every endeavour will be made to ensure that the website and any scripts or programs are free of errors, JP Web Creations cannot accept responsibility for any losses incurred due to program malfunction, the website or any part of it. Please see our Terms & Conditions for more information on the limitation of our liability.
The website, graphics and any programming code remain the property of JP Web Creations or their respective copyright holders.
Any scripts, CGI applications, PHP scripts, or software (unless specifically agreed) written by JP Web Creations remain the copyright of JP Web Creations or their respective copyright holders and may only be commercially reproduced or resold with the permission of JP Web Creations.
JP Web Creations cannot take responsibility for any copyright infringements caused by materials submitted by the client or otherwise. We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material.
We will also refuse to publish content or make changes that we deem offensive or illegal – At this point, we may refuse to continue developing your site or hosting your website or email.
JP Web Creations cannot take responsibility for any losses incurred by the use of any software created for the client. Whilst every care has been taken to ensure products are problem-free and accurate, the ultimate responsibility lies with the client in ensuring that all software is functioning correctly before use.
We recommend clients do not neglect their websites and regularly check that they are performing as they should. Unless pre-contracted JP Web Creations will not regularly check on the functionality of the website. However, if a problem arises please let us know straight away and we will always try to fix it or find an alternative option.
JP Web Creations makes every effort to ensure websites are designed to be viewed by the majority of visitors. Websites are designed to work with the most popular current browsers (e.g. Firefox, Internet Explorer 8 & 9, Google Chrome, etc.). By placing an order with JP Web Creations, clients agree that we cannot guarantee correct functionality with all browser software across different operating systems.
JP Web Creations do not accept responsibility for web pages which do not display acceptably in new versions of browsers released after the website has been designed and handed over to the Client. We reserve the right to charge the Client if additional work is needed in order to work on newer and updated browser releases.
NOTE: We use WordPress and it is very unlikely that new browser updates would prevent the website from performing or displaying in the correct manner.
JP Web Creations reserve the right to pass on additional charges incurred to the Client. For example, late changes and extras that were not agreed upon at the point of sale.
From time to time Clients chose to move their website or hosting elsewhere. This is normally something they need help with, JP Web Creations will charge a fee of £50 per hour in order to help the client move the website away from our servers.
JP Web Creations will offer no refund of hosting, email or any fees if the Client chooses to move their website away. We will also not provide licenses for any additional paid software or plugins used if owned by JP Web Creations, for example, Elementor Pro. The Client will be responsible for purchasing these independently.
Once a client chooses to remove their website from our servers, this is where our responsibility or liability ends. We cannot be held responsible for any aspect of the website or content from this point forward.
JP Web Creations services may be used for lawful purposes only. You agree to indemnify and hold JP Web Creations harmless from any claims resulting from your use of our service that damages you or any other party.
These terms and conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these terms and conditions shall be subject to the non-exclusive jurisdiction of the English courts. We do not warrant that materials/items for sale on the Website are appropriate or available for use outside the United Kingdom and Eire. It is prohibited to access the Website from territories where its contents are illegal or unlawful. If you access this Website from locations outside the United Kingdom and Eire, you do so at your own risk and you are responsible for compliance with local laws.
JP Web Creations are proud of the websites we create and as such, we place our ‘credit’ in the footer area of a Clients website. If a client wishes to remove this credit, we require a fee of £250. If the client removes this without our consent and payment, we may refuse to continue developing your site or hosting your website or email.
By placing an order with JP Web Creations the client is also agreeing to us placing images of your website within our portfolio and using them on social media etc.
JP Web Creations may purchase agreed domain names on behalf of the client. JP Web Creations hold no liability over these domain names and it is the client’s responsibility to ensure they are renewed on time.
JP Web Creations cannot be held accountable for the loss of domain names or additional costs for renewing an expired domain if the client has not paid their renewal invoice on time.
JP Web Creations consider acceptance of these terms by the Client from the point at which they make payment of any kind against an invoice sent by JP Web Creations.
From time to time we may make changes to our Terms of Service to ensure that it is accurate and up to date and to reflect any changes in the law. This policy was last updated in July 2022.
